The SBA recently updated their Paycheck Protection Program guidance to address situations where a borrower offers to rehire an employee, but the employee declines the offer. As long as the borrower makes a good faith, written offer of rehire, and the borrower documents the employee’s rejection of that offer, the borrower’s PPP loan forgiveness amount will not be reduced. Additionally, employees who reject offers of re-employment may forfeit eligibility for continued unemployment compensation. This guidance may be found under FAQ #40 in the SBA’s PPP Frequently Asked Questions document.
