News from Representative Tom Emmer

Dear Friend,

Last week, a federal judge in Texas struck down the Affordable Care Act (ACA) as unconstitutional. Specifically, Judge Reed O’Connor ruled for about 20 state plaintiffs that the ACA’s individual mandate is no longer legal because Congress repealed its financial penalty as part of the 2017 Tax Cuts and Jobs Act. This move has injected fear and uncertainty back into the market.

Republicans and Democrats may not agree on every detail when it comes to health care, but all Americans agree on two things: The current system under the ACA is broken, and health care is too expensive.

If you receive coverage through the ACA, you may ask, “What is going to happen to my health care?” I want to make sure you know a few things:

  • This opinion does not immediately repeal the ACA.
  • Your coverage will continue as normal as the case proceeds.
  • I will continue to fight for you and your family to fix the broken system, including supporting coverage for people with pre-existing conditions.

I encourage you to visit Minnesota’s Department of Human Services online for more information regarding deadlines, renewal dates, answers to frequently asked questions and more.

While I do not agree with government-funded health care, the safety of you and your family is my top priority as your representative in Congress. If you have any questions, please do not hesitate to give my office a call.
