Backdating your Claim

How do I backdate my claim?

If you are already filing on an existing claim or if you are filing a new claim and you would like to backdate to the date you were affected by the pandemic, there will be a link that will appear after logging into UInv's Claimant Self-Service system to submit the request. Follow the instructions after clicking on the link and read all advisories listed on the page. Once your backdate request is approved, you will need to file weekly claims for the week(s) requested.

NOTE: It is important to request a backdate on your claim via the UInv portal rather than call in to the call center, if possible. Calling in to the call center for a backdate on your claim may cause a delay in receiving your benefits.

What if I do not see a link to backdate my claim online?

The link does not appear on all claims. Combined Wage Claims (CWC), claims using Federal (UCFE) or Military (UCX) wages, for example, will not display a link for a backdate request. Claims with a current open issue or a disqualifying issue will not be provided the backdate link at this time due to the complexity of those claims. The agency is continuing to work on programming for these various claim situations to allow for online backdate requests. Until that functionality is available online, claimants who are not presented with the backdate link will have to call into the Telephone Claims Center for assistance.

*Weekly Benefit Amounts are calculated on your base period earnings. The base period changes each quarter. The most recent quarter change was on 4/5/2020. Backdating your claim to an effective date prior to 4/5/2020 will cause a recalculation in both your weekly benefit amount and your maximum benefit amount. The recalculation may increase, decrease, or not affect your benefit payment eligibility amount.

Overpayments

Occasionally, benefits are improperly paid. Overpayments may occur for a variety of reasons that may include, but are not limited to, claimant error, appeal reversals, fraud, failure to report earnings or income, or Division errors. All overpaid benefits must be repaid to the Division. If you are not at fault for creation of the overpayment, the Division may withhold your weekly benefit entitlement and apply that amount to repay the overpayment. You may be eligible for a reduced weekly withholding. Contact the Benefit Payment Control Collections office at (775) 684-0475 to discuss your eligibility for this option.

Pandemic Unemployment Assistance

How do I know if I am eligible for PUA?

If you are self-employed, seeking part-time employment, do not qualify for regular UI or have exhausted all UI, PEUC, or SEB benefits and have been affected by the COVID-19 pandemic you may qualify to receive benefits. You are affected by the COVID-19 pandemic if you are unemployed, partially unemployed, unable to work or are unavailable for work due to one of the following reasons:

  • You have been diagnosed with or are experiencing symptoms of COVID-19 and are seeking a medical diagnosis;
  • A member of your household has been diagnosed with COVID-19;
  • You are providing care for a family member or a member of your household who has been diagnosed with COVID-19;
  • Your child or other persons in the household for whom you are the primary caregiver is unable to attend school or another facility that is closed due to the COVID-19 pandemic, and directly affects you from working;
  • You are unable to reach your place of employment because of quarantine or stay-at-home order due to the COVID-19 pandemic;
  • You are unable to reach your place of employment because you have been advised by a health care provider to self-isolate or quarantine because you are positive for or may have had exposure to someone who has or is suspected of having COVID-19;
  • You were scheduled to start a new job and do not have an existing job or are unable to reach the job as a direct result of the COVID-19 pandemic;
  • You have become the breadwinner/major supporter for a household because the head of your household has died as a direct result of COVID-19;
  • You had to quit your job due to being diagnosed with COVID-19 and being unable to perform your work duties; or
  • Your place of employment is closed as a direct result of the COVID-19 pandemic.
  • You are self-employed or an independent contractor and have experienced a slowdown in business due to COVID-19 which has forced you to suspend operations.

What kind of documentation do I need to provide to show my previous income?

Documents which show your total income for the entire year such as tax documents (preferable), as these allow a quicker review of your total earnings. Acceptable documentation you can provide may include but is not limited to W-2 forms, tax returns, paycheck stubs, bank receipts, ledgers, invoices, and billing statements. Providing this documentation may increase your benefit amount based on a percentage of earnings. Documentation will need to be provided within the PUA application; documentation which has been sent to DETR through other means will not be transferred to PUA.

Reminders

Verifications

As part of DETR’s dedication to ensure that claims are properly adjudicated, all claims are equally and thoroughly reviewed including examining duplicate information received to ensure there is no new information overlooked or missed. Reviewing duplicate and triplicate copies of information will result in adding time to the adjudication process. Therefore, we encourage filers NOT TO send information more than once unless directed to do so.

Work Search Requirement

In accordance with guidance from the Department of Labor and based on Governor Sisolak's previous waiver of the work search requirement, the Administrator of DETR's Employment Security Division has announced that UI filers will continue to be afforded the work search waiver until further notice or direction from the U.S. Department of Labor.

Weekly Claims

Please continue to file according to the first initial of your last name and during non-peak hours: later in the evening, early mornings and weekends. Filers MUST file weekly claims to continue receiving benefits.

If you have returned to work and no longer wish to request benefits, simply stop filing your weekly claims. The state will interpret this as you have returned to work, or no longer with to claim benefits. It is not necessary to contact the Division to stop your benefit payments. Returning to work will not interfere with any back payments you may be eligible for.
